LIVING/LEARNING CENTER CONTRACT

Assignment and Occupancy
The University agrees to consider the information on the Housing Agreement form when assigning living accommodation, but NO GUARANTEE OF A SPECIFIC ASSIGNMENT IS IMPLIED. Discriminating requests and practices are contrary to the philosophy and policies of the University and will not be considered.

Present residents are invited to participate in the room selection process which occurs between January and March. Priority in the assignment of students to Living/Learning Centers is given in the order of the date the room deposit is received. Roommate preference is honored only on mutual request, but there are no guarantees. THE UNIVERSITY RESERVES THE RIGHT OF LIVING/LEARNING CENTER AND ROOM ASSIGNMENTS AND REASSIGNMENTS WHEN SUCH ARE DEEMED NECESSARY.

If vacancies occur in a room throughout the year, the remaining students in that room agree to accept other roommate(s) as assigned or move into other available spaces.

If a student fails to occupy an assigned room or make written notification of late arrival by the start of the second week of classes the student gives up all reservation and claim to any room on campus. The student will be released from all obligations under this Housing Agreement and all amounts which the student has previously paid pursuant to this Housing Agreement shall be refunded with the exception of $300.00 non-refundable room reservation fee and a $100.00 penalty.

ROOM WITHDRAWAL

If your application for room assignment is accepted and you decide not to live in the Living/Learning Centers, you must first notify the Assistant Director of Residence Life in writing. Prior to the first day of classes you will only lose your $300.00 non-refundable deposit. If you notify the Assistant Director after classes begin but do not move in, you will be charged $400.00. If you move into your room and then move out, you will forfeit the entire room fee. A refund of 75% of the board fee will be refunded if departure is prior to the mid-point of the semester.

ROOM CANCELLATIONS/END OF FALL SEMESTER
Students planning to leave the Living Learning Centers after the first semester for any reason must complete and submit a Spring Release Form, available in the Office of Residence Life after mid-November. Each student who submits a Spring Release Form will then have an Exit Interview with the Assistant Director of Residence Life (exceptions will be discussed during the Exit Interview). In most cases, cancellation of the Housing Agreement will result in a $500.00 penalty. Freshman and sophomore students who wish to be released from the Housing Agreement must refer to the Campus Residency Policy. If you notify the Office of Residence Life after the first day of Spring classes, you will forfeit the entire room cost. An amount equal to 75% of the remaining board will be refunded. No refund will be given after the mid-point of the semester.

VACATION PERIODS

The Living/Learning Centers close during Thanksgiving, Christmas, Spring Break, Easter and between semesters. Residents may leave personal effects in their rooms. The University will take responsible security precautions during these times, BUT WILL NOT BE RESPONSIBLE FOR ANY STUDENT LOSSES.

When a student leaves for the summer, all personal property must be removed from the room. RESIDENTS SHOULD MAKE TRAVEL PLANS BASED ON THE UNIVERSITY CALENDAR ; NO ONE IS PERMITTED TO STAY LATER OR ARRIVE EARLIER THAN THESE TIMES. Special arrangements are made for international and non-continental students for vacation periods. Notification of sign-up deadlines will be posted in each building. Students may be required to move to another residence hall during the vacation period

STORAGE

Limited storage space is available in the Living/Learning Center. The number of pieces one can store will be determined at the beginning of each academic year; priority is given to international students. A detailed memo will be posted informing students of the procedure for storage pieces in their living area.

Although reasonable precautions will be taken, Duquesne University assumes no responsibility for pieces stored.

TERMS OF AGREEMENT
The Living/Learning Center Agreement term is effective for the entire academic year, until twenty-four (24) hours after your last exam at the end of the school year. Students will be released from the second semester portion of the contract for the following reasons only; 1) academic dismissal from the University; 2) withdrawal from the University between semesters; 3) student teaching (for those students who can illustrate more convenient housing off campus); and 4) graduation. All releases for the second semester portion must be approved by the Office of Residence Life.

Any resident student leaving the Living/Learning Center must follow the checkout procedure (including turning in the room key) as established by the Office of Residence Life. Failure to do so will result in forfeiture of any refund, which may be due.

RATES
Living/Learning Center rates are determined on an annual basis. The University shall have the right to change the rates charged for room and board at any time. For Duquesne students, the entire semester charge for room and board is due at final registration. Arrangements may be made with the Student Finance Office for deferred payments.

In the event the student is authorized to change his/her room or hall assignment, or both, and the charge change constitutes an alteration of residence halls fees, the Housing Agreement will be amended and the appropriate billing will be made.

Freshmen, transfer students or any student entering the Living/Learning Center for Orientation at the beginning of the year will pay an additional fee for board during this period.

Please note: Room and board rates do not include housing during University established breaks

DAMAGES
The student shall be responsible and pay for any damages caused by the student or the student's guests or invitees to the living quarters, furnishings or to any other area of the Living/Learning Center or it's equipment. At the expiration of this agreement, the student shall leave his/her living quarters in the same order and condition of repair as when he/she took occupancy, reasonable wear and tear excepted.

A. Student Rooms
A room inspection form is completed by Residence Life staff prior to the time that a student moves into a room. It is the responsibility of the resident student to review this form and point out any damages to his/her Resident Assistant. Students are liable for the damage cost of any item that is vandalized or damaged during the time of occupancy. Damage in a student room that cannot be tracked to a single individual will be billed to both residents of the room.
It is imperative that students read and sign the room inspection form on move in day and upon departure. Damages are assessed based on the condition of the room and the information on the inspection form.

B. Common Areas Students are responsible for damage in the common areas in which they live. If damage, vandalism, and/or theft of university property occurs in a common area, residents will be given notice and an opportunity to identify the individual(s) responsible. If a responsible party is not identified, all residents of the living area may be charged for repair of the damage/vandalism and/or replacement of stolen property.

C. Costs
Costs for labor, repair or replacement of damaged items is determined in conjunction with Physical Plant/Maintenance personnel. A list of suggested vandalism/damage costs follows. These prices may fluctuate as labor or material costs fluctuate.
