Sanctions for
Violations of Residence Hall
Policies and Procedures
Listed
below are approved sanctions for violations of
Residence Life policy and procedure. Please note
that the following information is intended to
provide a guideline for students. Discretionary
and/ or punitive sanctions may be deleted or added
at the discretion of the Resident Director. In
extreme or repetitive cases, as well as in violations
that could result in a sanction above LLC suspension,
students may be referred to the Director of Judicial
Affairs for judicial proceedings.
As of Fall
2002, the Director of Judicial Affairs shall serve
as the convener of the University Judicial Board
and shall serve as chair of the Judicial Board
hearings but shall have no vote in the Board's
determination.
Two (2)
at large students, taken from an established pool
of six (6) at large students who have participated
in judicial training sessions conducted by the
Director of Judicial Affairs.
Three (3)
faculty or University officials, taken from an
established pool of nine (9) faculty or University
officials who have participated in judicial training
sessions conducted by the Director of Judicial
Affairs
A majority
vote is necessary to find a student in violation
on any change, and each charge must be voted upon
separately.
The judicial
process will begin within five working days from
the time of the incident. A student failing to
comply with the given directives will face additional
judicial action. In addition, a student failing
to comply with an assigned sanction will face
additional sanctioning and fines along with the
required compliance with the initial sanction.
It is the
responsibility of all resident students to make
our residence halls and campus a safe place to
live. If you observe any violations of the University
Code of Conduct of Residence Life Handbook, it
is your responsibility to notify a residence life
staff member. Failure to do so may result in your
being held responsible for the consequences.

Violation:
Alcohol
- includes
possession, use, presence and public intoxication
in an area where alcohol is being used in violation
of campus policy and/ or state law.
Students
should note that the laws of public intoxication
(defined in PA State Law as appearing in any public
place manifestly under the influence of alcohol
to the degree that s/he may endanger himself or
other persons or property, or annoy persons in
his vicinity) as well as the use of alcohol for
minors do apply to those of the legal drinking
age (21) and will be enforced as necessary. Students

Sanctions:
First
Offense:-
mandatory meeting with the Resident Director;
attendance at alcohol education program and monetary
fine
Subsequent
Offenses: - additional discretionary
programming/ activities, monetary fines, parental
notification, loss of on-campus housing, referral
for evaluation by treatment center. Additional
fine of $ 100.00 will be assessed to any person(s)
having possession of a common source of alcohol
(such as kegs, party balls, open bowls/ containers,
etc.)
Violation:
Assault
- any willful
attempt or threat to inflict injury upon the person
of another.
Sanctions:
Meeting
with the Resident Director and/or Campus Police,
possible legal action, suspension or expulsion.
Violation:
Aggravated Assault
- any attempt
or threat to inflict injury upon the person of
another with a dangerous instrument or deadly
weapon.
Sanctions:
Suspension
or expulsion from the University.
Violation:
Intimidation
- willfully
creating fear of bodily harm, or coercion, extortion
or duress.
Sanctions:
Meeting
with the Resident Director and/or Campus Police,
possible legal action, suspension or expulsion
from the University.
Violation:
Heroin
- possession
of substance, use and/or sale.
Sanctions:
Expulsion
from the University.
Violation:
Marijuana - includes possession of substance
and/ or paraphernalia, as well as suspected use
Sanctions:
First Offense: - mandatory meeting
with the Resident Director; attendance at an education
program, monetary fine, LLC probation, and parental
notification. Subsequent
Offenses: - additional discretionary
programming and/or activities, reassignment of
LLC or loss of on-campus housing, extended LLC
probation and/or University suspension/expulsion,

Violation:
Illegal Drugs(except for Heroin and Marijuana)
- includes
possession of substance and/ or paraphernalia,
as well as suspected use in violation of campus
policy
Sanctions:
First
Offense: - mandatory meeting with
the Resident Director; attendance at an education
program, monetary fine, LLC probation, and parental
notification. Subsequent
Offenses: - additional discretionary

Marijuana and Other Illegal Drugs

recommended suspension/expulsion from University.

Vandalism

Restitution
for damages, fines, relocation to another LLC
and/or loss of on-campus housing.
Violation:
Tampering with Security Screens
Sanctions:
Payment
of replacement/installation of damaged item ($350.00),
monetary fine, written reprimand from Resident
Director
Violation:
Tampering with Security Doors

Loss of
visitation privileges, monetary fine
Violation:
Tampering with Fire Alarms/Sprinkler Equipment
Sanctions:
Meeting
with Resident Director, immediate LLC probation,
possible LLC suspension/expulsion, and notification
of legal authorities, $500.00 fine
Violation:
Failure to Evacuate during Fire Alarm
Sanctions:
Meeting
with the Resident Director, discretionary sanction,
$50.00 fine,
Violation:
Possession/ Use of Fireworks

* If
for any reason a student is suspended from the
University housing, there will be NO credit made
on room and board charges.
